DEXTERITY SOFTWARE
LICENSING AGREEMENT
This Software Licensing Agreement ("Agreement") is a legal agreement between
you, the end user, and Dexterity Software ("Dexterity"). By installing
this game program, by loading or running the game, or by placing or copying
the game program onto your hard drive, you agree to be bound by the terms
of this Agreement. These are the only terms by which Dexterity permits
copying or use.
DEXTERITY SOFTWARE LICENSE
General terms:
1. Grant of License.
Dexterity grants you the right to the use the game program which is the
shareware version of the full game. You may load the software into RAM
as well as install it on a hard disk or other storage device. You may not
modify, translate, disassemble, reverse engineer, decompile, or create
derivative works based upon the game program. You agree that the game
program will not be shipped, transferred, or exported into any country in
violation of the U.S. Export Administration Act and that you will not
utilize the game program in violation of any applicable law.
2. Copyright.
The game program is owned by Dexterity and is protected by United States
copyright laws and international treaties. You must treat the game
program like any other copyrighted material, except that you may make copies
of the game program to give to other persons under the terms of this
Agreement. Except as expressly licensed by Dexterity, we reserve the
exclusive copyright and all other rights, title and interest to distribute
this program, and to use Trademarks in connection with them. Trademarks
refers to the name of this program and the name Dexterity Software, which
are trademarks of Dexterity Software.
3. NO WARRANTY.
THE PROGRAM IS PROVIDED "AS-IS". NO WARRANTIES OF ANY KIND,
EXPRESS OR IMPLIED, ARE MADE AS TO IT OR ANY MEDIUM IT MAY BE ON.
WE WILL PROVIDE NO REMEDY FOR INDIRECT, CONSEQUENTIAL, PUNITIVE
OR INCIDENTAL DAMAGES ARISING FROM IT, INCLUDING SUCH FROM
NEGLIGENCE, STRICT LIABILITY, OR BREACH OF WARRANTY OR CONTRACT,
EVEN AFTER NOTICE OF THE POSSIBILITY OF SUCH DAMAGES.
4. General Provisions.
This Agreement is the sole and entire Agreement relating to the subject
matter hereof, and supercedes all prior understandings, agreements, and
documentation relating to such subject matter. If any provision in this
Agreement is held by a court of competent jurisdiction to be invalid, void,
or unenforceable, the remaining provisions will continue in full force
without being impaired or invalidated in any way. This Agreement will be
governed by the laws of the State of California. With respect to every
matter arising under this Agreement, you consent to the exclusive
jurisdiction and venue of the state and federal courts sitting in
Los Angeles, Calfornia, and to service by certified mail, return receipt
requested, or as otherwise permitted by law. This Agreement does not
create any agency or partner relationship. Your right to distribute under
this Agreement is personal, and does not include any right to sublicense the
game program. This Agreement may be terminated by Dexterity by giving a
30 day advance written notice.
5. Distribution.
Dexterity allows and encourages all bulletin board systems, online services,
shareware disk vendors, CD-ROM vendors, and end-users to distribute
this game as long as no files are altered or removed. If you wish to
commercially distribute this program on a CD-ROM, we require that you send
us a copy of the CD-ROM as soon as it has been manufactured. Additionally,
if you wish to commercially distribute this program in a retail environment,
we require that you send us a copy of your packaging as soon as the
packaging has been manufactured. You may bundle this shareware game
product with new hardware as long as you don't modify or delete any
program files. In all of these cases, anyone distributing Dexterity
shareware products for remuneration must first contact Dexterity at the
address below for authorization. This authorization will automatically
be granted to distributors recognized by the ASP as adhering to its
guidelines for shareware distributors, and such distributors may begin
offering the shareware game program immediately. However, Dexterity must
still be advised so that the distributor can be kept up-to-date with the
latest version of the game program.
6. Distribution opportunities.
Please contact Dexterity if you would like to distribute Dexterity products.
We appreciate dealing with vendors interested in introducing our games to
new markets.
We thank you for distributing Dexterity Software products in accordance
with the terms of this agreement.
